Who you are agreeing with
Fomio is operated by FLOW SOFTWARE L.P., registered in Greece as GEORGANTZELIS ANDREAS KAI SIA L.P., company no. 184467906000, VAT EL802877827, at Leoforos Dimokratias 1, Oraiokastro, 57013 Thessaloniki, Greece. Using the service means you accept these terms. If you are using it for a company, you are confirming you are allowed to agree on its behalf.
What the service does
You give us the address of an app. We load it on a schedule from outside your infrastructure, decide whether it looks healthy, and email you when that changes. If you paste our snippet into the app itself, we also hear about errors your own visitors run into. When something breaks we explain, in plain language, what probably went wrong and what to try.
Your account
- You need a working email address. Sign-in is by a link sent to it, so whoever can read that inbox can get into your account — keep it secure.
- One account per person. Don’t share logins.
- You must be 16 or over.
What you may and may not watch
Watch your own things, or things you have permission to watch. Our checks make ordinary requests at a modest rate, but pointing them at someone else’s site without their agreement is not something we will host.
Specifically, don’t use Fomio to:
- Load anything at a rate intended to slow it down, or to test whether it can be slowed down.
- Watch a site you have no relationship with in order to gather information about it.
- Monitor anything illegal, or anything that infringes someone else’s rights.
- Attempt to get around plan limits by creating multiple accounts.
We can suspend an account that does any of this. Where it is reasonable to do so, we will tell you why first.
The snippet, and your own visitors
If you install our error-reporting snippet, it collects information about errors on your site — described exactly in the Privacy Policy. For that data, you are the one responsible for it and we act on your instructions. Two things follow, and both are yours to do:
- Tell your own visitors, in your own privacy notice, that you use a monitoring service.
- Don’t deliberately push personal data into the snippet. It is built not to collect any — identifiers are stripped from paths before they are stored — but that only holds if you don’t work around it.
Paying
- The free plan is free, with no card and no time limit. Builder is €15 a month and Pro is €29 a month, each billed monthly in advance until you stop it.
- Payments are taken by Stripe. Cancelling, changing your card and downloading invoices all happen on Stripe’s billing screen, which you reach from your account page.
- Cancel any time. Your plan keeps working until the end of the period you have paid for, and then stops. We do not pro-rate a refund for the rest of a month, and we do not charge you again.
- If a payment fails we keep your plan running while the card is retried — about two weeks — rather than switching your monitoring off the same day.
- If you drop to a plan covering fewer apps, the newest ones are paused rather than deleted, and we email you which ones. Nothing is lost, and upgrading again turns them back on.
- Prices can change. Existing subscribers get at least 30 days’ notice by email before it applies to them, and a launch price we promised to hold is one we hold.
What we don’t promise
This is the section to actually read, because it is the one where a monitoring tool is most tempted to overstate itself.
- We can miss things. We check on an interval, not continuously. An outage that starts and ends between two checks is one we never saw.
- We can be wrong. Something between us and your app — a network, a firewall, a rate limit, a bot filter — can make a healthy app look broken to us. We require several failed checks in a row before telling you, which makes this rare rather than impossible.
- An alert can fail to arrive. Email is not guaranteed delivery. It can be delayed, filtered, or land in spam.
- The explanations are a best guess. The plain-language diagnosis and the fix prompt are produced by an AI model from limited evidence. They are a starting point, not a verdict, and you should read any suggested change before running it.
- Fomio is not a backup, a security tool, or a substitute for testing. It tells you something broke. It cannot stop it breaking.
The service is provided as it is. We do not promise it will be uninterrupted or error-free, and there is no uptime guarantee on the free plan.
If something goes wrong
If we fail you and it costs you money, what we owe is capped at what you paid us in the 12 months before it happened — or €50 if you are on the free plan. We are not liable for lost profits, lost customers, or business interruption caused by an outage we failed to catch.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited. If you are a consumer rather than a business, your statutory rights are unaffected by any of this.
Stopping
You can delete your account whenever you like, and doing so deletes your apps and their history. We can close an account that breaks these terms, or with 30 days’ notice for any other reason — in which case we refund the unused part of anything you have paid.
Changes to these terms
If we change something that matters, we email you at least 30 days beforehand. Carrying on using Fomio after that means you accept it; if you don’t, cancel and we will refund the unused part of the period.
Law
These terms are governed by the law of Greece, and its courts have jurisdiction. If you are a consumer, this does not take away the protection of the law where you live.
